1. House for Positive Change

House for Positive Change is located at Dobbeweg 11R, 2254 AG Voorschoten and is registered in the trade register under number 72438703.

The website of House for Positive Change is www.houseforpositivechange.com.

All communication about our products and services is done via info@houseforpositivechange.com.

2. Applicability and validity

The general terms and conditions apply to all House for Positive Change products and agreements.

The conditions can be changed by House for Positive Change during the term of the agreement.

The latest version is always the applicable version and available on the website, so keep a close eye on it.

3. Subscriptions


3.1. Personal

All subscriptions are personal and non-transferable. An overview of all types of subscriptions can be found on the website.

3.2. Included lessons

A continuous monthly subscription entitles you to participate in regular yoga classes with a credit for monthly lessons or the option to take unlimited yoga classes. The regular class schedule is listed on the website.

3.3. Purchase

You can conclude in person in the studio by completing the registration form or via the webshop.

3.4. Minimum registration period

The minimum registration period for a subscription is one full month.

3.5. Catching up on lessons

Missed lessons may be made up within 1 month, provided there is room in the relevant lesson. Regular participants take precedence over catching up students. Missed lessons that are not made up are not eligible for a tuition refund. For unlimited subscriptions, catching up on lessons does not apply.

3.6. Student discount

The student unlimited subscription is only accessible upon presentation of a valid student card, which must be able to be shown at any time. The expected end date of the study must be known to House for Positive Change.

3.7. Termination and notice period

Termination of the monthly subscription takes place automatically at the end of the calendar month. Only in the event of illness/hospitalization for which a doctor's note is submitted to House for Positive Change, the subscription can be terminated earlier than the monthly term. No refunds can be made for an already running month.

3.8. Subscription granted

It is possible to extend the subscription immediately. The additional amount must be transferred in advance or paid by PIN.

3.9. Payment

Payment for the subscription must always be made before the 1st of the month via the webshop or PIN. If the amount has not been received by House for Positive Change, you will receive a reminder and you must transfer or debit the outstanding amount within 3 days. If it is not paid, you will receive a reminder plus €15 administration costs, which must be paid within 14 days. This will be followed by a reminder plus €15 administration costs, which must be paid within 14 days. If payment is deferred, the collection agency will be contacted.

If payment has not been made for a subscription, the subscription will be blocked and access to the lessons will not be possible.

Once payment has been made, the subscription will be unblocked. You will always remain liable for the overdue installment payments and administration costs until the subscription is cancelled in accordance with the conditions.

4. Class card, Introductory offers, Drop in class, Gift voucher


4.1. Unlimited Class Pass

  • The Unlimited Class Pass is personal and non-transferable.
  • The Unlimited Class Pass can be purchased in the studio or via the webshop.
  • The Unlimited Class Pass entitles you to regular yoga classes four times a week
  • The Unlimited Class Pass is valid for one calendar month. Lessons not used will be cancelled.
  • People aged 60 and over can opt for an attractively priced Unlimited Class Pass at House for Positive Change upon presentation of a valid ID.

4.2. Introductory offers

As a new student at House for Positive Change you can choose the Introductory Class Card to try out a regular yoga class.

4.2.1. Introducing Class Card

  • The Introductory Class Card is valid for 1 month.
  • As a new student you can use this once if you have not previously taken a lesson at House for Positive Change.
  • Purchase via the webshop or directly in the studio by PIN.

4.3. Drop in class

  • Everyone can take advantage of a drop-in lesson.
  • You pay for 1 separate lesson.
  • Purchase via the webshop or directly at the counter.

4.4. Gift voucher

  • The gift voucher can be tailor-made with a product of your choice (for example a massage, Ayurvedic Lifestyle and Nutrition Consult, an Introductory Class Card, an Unlimited Class Pass, etc.).
  • The gift voucher is valid for 1 year from the date of issue.
  • It is best to email your product choice in advance so that we can prepare the receipt for you.
  • The gift voucher can then be collected at the counter and must be paid by PIN.

5. Reservations for lessons, lesson schedule


5.1. Reservation

For the lessons at House for Positive Change, a reservation request can be made in advance via the website

5.2. To register

Before each lesson you must register with the teacher. After the teacher has checked the registration and payment for the relevant lesson, participation is possible.

5.3. Current schedule

The applicable class schedule is always on the website. House for Positive Change reserves the right to change the class schedule at any time. Any changes will be announced in advance, as far as possible.

5.4. Lesson cancellations

In the event of force majeure, it may be necessary to cancel a planned lesson or use a different teacher than stated on the schedule. There are no refunds for changes to a lesson or teacher.

5.5. No lesson

House for Positive Change is open almost all year round, with the exception of public holidays and working periods abroad. All days that the studio is closed or that no lessons take place are listed on the website.

6. Workshop/ course/ event | Private session


6.1. Workshop, course, event

6.1.1. Registration

The agenda with workshops, courses and events is always listed on the website. Reservations and payment are made via the webshop.

6.1.2. Cancellation by House for Positive Change

Due to force majeure or insufficient registrations, a planned workshop may be cancelled. In that case, the registration fee already paid will be refunded.

6.1.3. Cancellation

You can cancel your registration free of charge in writing by email up to one (1) month before the planned workshop date. You can cancel your registration up to two weeks (14 days) before the planned workshop, in which case the registration fee will be refunded minus € 25 administration costs. If you cancel your registration within two weeks (14 days) of a scheduled workshop, no refund will be made. However, the spot can be transferred to someone else.

6.2. Private session: Private lesson, (Ayurveda) consultation, massage, healing or therapy session

6.2.1. Booking

You can receive a private lesson, (Ayurveda) consultation, massage, healing or therapy session after you have made an appointment by telephone or email.

6.2.2. Payment

Payment is made in advance via the webshop or by PIN in the studio.

6.2.3. Cancellation by House for Positive Change

As a result of force majeure, we may be forced to cancel an appointment. In that case, a replacement appointment will be scheduled.

6.2.4. Cancellation by student

Up to 24 hours before the planned private session, you can cancel the appointment free of charge by email and a new appointment will be scheduled. No refunds are available if you cancel within 24 hours of a scheduled private session.

6.2.4. Important

Massages and other Ayurvedic treatments can contribute to a healthy lifestyle. The therapists at House for Positive Change are not doctors and therefore not qualified to diagnose illness, injuries or other conditions or injuries. The treatments at House for Positive Change are not alternatives to medical treatments. Before treatment, you must report any illness and/or medication use.

7. Payment and price changes


7.1. General

All payments must be made prior to the service. Payment can be made by payment via the webshop or via PIN.

7.2. Price change

The applicable prices for all products and services are always on the House for Positive Change website. House for Positive Change reserves the right to change prices at any time.

8. Liability


8.1. Reporting restrictions

You must always inform the teacher in advance of any injuries, physical limitations, health problems or pregnancy. Restrictions that you do not consider relevant should also be communicated for your own safety.

8.2. Risk during sports practice

At House for Positive Change we only work with qualified teachers and provide high-quality activities. The risk of injury and/or injury is always present when practicing a sport. For these reasons, House for Positive Change is not liable for injuries and/or injuries sustained. House for Positive Change has liability insurance for demonstrable complaints.

8.3. Valuables

House for Positive Change is not liable for any damage, loss or theft of personal, material goods. There are no lockers where items can be safely stored. Therefore, leave valuables at home as much as possible and take what is valuable with you to the yoga room.

9. House rules


At all times, students and participants are requested to respect and comply with the house rules of House for Positive Change:

  • Shoes are not worn in the yoga room and consultation room.
  • Always come to the studio fresh and clean. Use as little strong perfume as possible. The senses are extremely open when practicing yoga.
  • Please do not spray strong deodorant, perfume or hairspray in House for Positive Change before and after class.
  • Do not use oil or lotion on your skin immediately before the yoga class because it will cause the mats to slide.
  • Under the influence of alcohol and/or drugs, participation in lessons will be immediately denied.
  • Phones are allowed into the yoga room provided they are turned off (airplane mode, no vibration function).
  • Large bags and the like must be left in the kitchen.
  • For hygiene reasons, clean your mat after taking a yoga class with the mat spray intended for this purpose.
  • If you practice yoga regularly, we recommend purchasing your own mat.
  • It is not allowed to bring tea or water into the yoga room when a yoga class is taking place. If you want to drink during class, please bring a sealable water bottle to the room. (Based on yoga philosophy, drinking during class is not recommended.)
  • Enjoy a cup of tea after class. Then place the cup on the kitchen counter.
  • Be polite, friendly and open.
  • Please be considerate of our neighbors.
  • Please park your car in the designated free spaces.

9.1. Denial of access

House for Positive Change reserves the right to deny access to House for Positive Change to visitors who, in its opinion, do not comply with the house rules and to terminate the contractual relationship without refunding any products already paid for.

10. Complaints


10.1. Notification

Please let us know if you are dissatisfied. We would be happy to discuss this in order to arrive at a suitable solution together.

Retreat/Trip Terms and Conditions

Your contract is with the House for Positive Change.

Below are the details of the terms and conditions of the booking agreement. Please read them carefully. When you make a booking and we accept it, a legally binding contract is applicable. When you sign a booking form or fill one in online, you (and any other person on whose behalf you book) agree to accept all these conditions; you acknowledge that you have read the relevant retreat/trip information and the general information. You also warrant that the information given by you on the booking form is complete and true. This contract is based on the terms of these booking conditions.


1. HOW TO BOOK?

Payment Schedule for retreat/trip: Standard Conditions
  • To secure your spot, you must register with the specified retreat/trip sign-up fee, which is non-refundable under any circumstances.
  • 50% of the retreat/trip cost will need to be sent by bank transfer 90 days before retreat/trip departure.
  • Final payment 60 days before retreat/trip departure.
Please note:
  • For certain retreat/trip, the booking condition period may vary. Please carefully review the information provided on the website along with the retreat/trip details.
  • On all payments made by bank transfer, bank charges will have to be borne by the clients.

2. Payment

The prices quoted are for payment by wire transfer or cheques. The tour price is payable to House for Positive Change, 60 days prior to departure. For some special retreat/trip, the whole amount needs to be paid up to 120-90 days before retreat/trip departure. Failure to pay by that date entitles House for Positive Change, to cancel your booking without notice and without refund of the deposit. Prices are quoted are in EURO.

3. Package Prices

The cost quoted for any of the retreat/trip is a package cost and the retreat/trip quote lists out all the cost inclusions and exclusions. Package prices are based on ground costs, airfares and exchange rates. House for Positive Change, tries its utmost not to increase tour prices (in full or part), however sometimes increases are outside our control. We reserve the right to amend tour prices (or any part) without notice at any time before and including the departure date. Amendments may be necessitated for many reasons including, but not limited to, exchange rate fluctuations, increased fuel costs, airfares, airport charges etc. Any increase in tour prices must be paid prior to the retreat/trip departure date.

4. Minimum Group Size Requirement

As there are certain fixed costs associated with running a retreat/trip, regardless of the group size, we may have to cancel a retreat/trip that falls below our Minimum Group Size Requirement. This happens very rarely. In the event we must cancel a departure, we will inform you immediately, just prior to the time of final payment. In such a case, we will issue you a full refund of payments made to us, except the sign-up fees amount per person which remains non-refundable. House for Positive Change, is not responsible for additional expenses you may have incurred while preparing for the retreat/trip (e.g. non-refundable air tickets, passport and visa fees, clothing, equipment, medical expenses.) This is why we highly recommend Cancellation Insurance or any insurance which will be of help according to your situations.

5. Airfare (if any)

Our payment, cancellation and postponement policies do not apply to air travel arranged through House for Positive Change. Full payment for air travel is usually due the day after we make your reservation. Cancellation and change policies are different for each airline we use.

6. Park Fees and Flights

Some parts of House for Positive Change retreat/trip involve entrance to managed areas, such as national parks. Some House for Positive Change, retreat/trip involve internal flights. Please note that the park fees and internal flight costs can change at any time and without notice. Retreat/trip members are responsible for any cost increase.

7. Health and Fitness Requirements

Participants must be in good health and reasonable physical condition. It is vital that participants with medical problems make them known to us well before departure. Our retreat/trip generally take place in remote areas where there is little or no access to normal medical services or hospital facilities. If required, evacuation can be prolonged, difficult and expensive. Medical and evacuation expenses will be the responsibility of the participant. This is why we highly recommend insurance covering emergency rescue and medical expenses.

8. Tour Leader/Manager Authority

Signing our booking form signifies your agreement to abide by the authority of the leader/crew member, who represents House for Positive Change. The decision of the leader as to the conduct, itinerary and objectives of the tour is final. If, in the opinion of the leader, your behavior or physical condition is detrimental to the safety, welfare and well-being of the group as a whole or any individual, or if the leader considers your general wellbeing will be put at risk by continuing with the retreat/trip, you may be asked to discontinue the tour. In this case you would not be entitled to any refund for unused services.

9. Retreat/Trip Member Responsibility and House for Positive Change Discretion

It is the retreat/trip member’s responsibility for understanding the nature of the retreat/trip they have elected to join, and for selecting a retreat/trip appropriate to their interests, health/fitness condition, and abilities. House For Positive Change, requires retreat/trip members to be prepared physically and mentally, and to have the appropriate personal equipment for the retreat/trip selected. Retreat/trip members must provide us with true and accurate information about their health, abilities, and preparations. House For Positive Change, reserves the right to dismiss a retreat/trip member at any time without the right of refund, for any reasons that House for Positive Change may later learn about the retreat/trip member, or if the retreat/trip member’s further participation may be detrimental to the individual or to other retreat/trip members or our trekking/supporting crew.

10. Personal Contact Information

We have found that retreat/trip members enjoy contacting one another prior to their House for Positive Change retreat/trip. For this reason, House for Positive Change provides each retreat/trip member with a list of their fellow retreat/trip members. The list contains the name, city, state, country, phone number and email address of each member. This list is sent only to you and your fellow retreat/trip members. If you wish to be excluded from this list, please inform us on booking your retreat/trip. If you elect not to be added to the group member list, then you will not receive the list of other members.

11. Disclaimers and No Guarantees

We make no warranties, assurances, representations, or commitments regarding any health or physical outcomes resulting from your participation in our retreat/trip, physical and yoga programs, or use of our website. This includes, but is not limited to, outcomes related to weight loss, weight gain, body composition, physical fitness, health, or overall well-being.

12. Vaccinations and Medications

You are solely responsible for researching and understanding the recommended vaccinations, immunizations, and medications necessary for travel to your destination. It is your obligation to arrange and bear the cost of these medical requirements and to ensure their timely completion in accordance with any applicable deadlines.

13. Travel Documents

It is your sole responsibility to obtain and maintain a valid passport with sufficient validity for re-entry into your country of origin, as well as to secure all necessary visas or travel permits required for entry into the country or state where the Retreat/Trip is conducted. All associated costs shall be borne by you.

14. Drugs and Alcohol

The possession, use, and consumption of drugs and alcohol are undertaken at your own risk and must strictly comply with all applicable laws. You agree to indemnify and hold us harmless from any and all claims, actions, damages, liabilities, fines, penalties, prosecutions, or legal proceedings arising directly or indirectly from your use or influence of drugs and/or alcohol. This indemnification extends to any harm or damage caused to third parties, persons, or property.

15. Legal Rights and Governing Law

Applicable Laws: Participation in our retreat/trip, as well as the use of our website and mobile application (if applicable), is subject to all relevant legal frameworks, including but not limited to the Dutch Civil Code (Burgerlijk Wetboek), Netherlands Authority for Consumers and Markets (Autoriteit Consument and Markt, ACM) and the Privacy Act.

Jurisdiction: These Terms shall be governed by the laws of The Netherlands. By engaging with our services, you consent to the non-exclusive jurisdiction of the court in The Hague.

Cancellation Policy

If it becomes necessary to cancel your retreat/trip, you must notify House for Positive Change, immediately in writing to the email provided by House for Positive Change. Once we receive your notice, cancellation will take effect. Please note that the following charges will apply on cancellation:


Cancellation:

  • In any case the sign-up fee per person remains NON-REFUNDABLE.
  • If cancellation takes place between 90 and 60 days prior to departure, 50% of the first down payment will be forfeited,
  • If cancellation takes place less than 60-30 days prior to departure, 75% of the tour price will be forfeited.
  • If cancellation takes place less than 30 days prior to departure, 100% of the tour price will be forfeited.
Please note:
  • For certain retreat/trip, the cancellation period may vary. Please carefully review the information provided on the website along with the retreat/trip details.
  • On all transaction bank transfer, bank charges will have to be borne by the clients.

If the cancellation is due to you having COVID-19/ “flu-like symptoms”, supported by a medical certificate OR due to any travel restrictions imposed by the national or local government we will hold the entire amount paid by you as a credit for one future retreat/trip. Sometimes last-minute cancellations could attract cancellation fees for third-party arrangements like air, train, or bus tickets; hotels; permit fees, processing fee, etc. Such cancellation charges if any would be borne by the customers. This will reduce the credit for the future retreat/trip. We will offer you an additional opportunity to join our future retreat/trip. However, if you are unable to attend, the entire amount will be non-refundable.

The tour price is quoted as a package. No partial refunds or credit will be given for services not used. We recommend that you obtain cancellation travel insurance upon booking. If you can replace your spot by getting someone else to take that seat, cancellation charges would be waived to the extent that there are no extra costs for House for Positive Change, like change in airfare booking etc. You are also to be charged with a processing fee of 5% of the retreat/trip price. Please note that these cancellation terms may be amended from time to time. Please note that transaction bank transfer cost will be borne by the clients.

Travel and Cancellation Insurance

It is important that you must be covered by adequate insurance for the complete duration of your retreat/trip. Your insurance must include cover for; medical expenses, personal liability, injury, theft, loss of personal belongings, death, cost of repatriation and evacuation via whatever means necessary including by helicopter/air ambulance. If, in the event of an emergency medical rescue or evacuation from a retreat/trip, either by foot, helicopter or otherwise the responsibility for the payment of such costs will lie directly with you. Any subsequent costs incurred for expenses such as hotels, food, transport etc. shall be borne by you. All baggage and belongings are always entirely at your own risk, and we will not take responsibility for loss, damage or accident to any luggage or property.

Delay, Cancellation or Change of Itinerary

House For Positive Change, reserves the right to cancel any retreat/trip prior to departure (including, but not limited to, by reason of too few people booking on any tour) in which case participants will be given a refund in full. In any case the sign-up fee per person remains NON-REFUNDABLE. However, you will not be entitled to make any further claim for any injury, loss, expenses or damage (either direct or consequential) or for any loss of time or inconvenience which may result from such cancellation (including but not limited to visa, passport and vaccination charges, or departure, gear purchases, airport and airline taxes).

It is possible that a route change, postponement or delay (either in relation to departure or to the duration of the retreat/trip) may become necessary due to inclement weather, snow and ice conditions, political restrictions or any other cause. In the event of a change, postponement or delay, participants have no right to refund of the tour price (in whole or in part) or other compensation for any injury, loss or damage.

Events Beyond Our Control

Force Majeure - House for Positive Change may, at any time, cancel or withdraw a tour or trek due to circumstances beyond our reasonable control such as weather or other acts of God, strikes, war, hostile governments, riots, fire, pandemics, etc. In these cases, we will, with no penalty to ourselves, undertake to notify you of the circumstances for our withdrawal of the retreat/trip. In the event we choose to cancel a retreat/trip for one of these uncontrollable and safety-oriented reasons, neither House for Positive Change nor our staff, vendors or service providers will be liable or responsible for refunds, reimbursements, increased or altered retreat/trip fees or damages to participants or clients. However, we will make reasonable effort to recover refunds from overseas suppliers. Any refunds we can get from them will be collected within two months from the original retreat/trip date, and we will do our best to secure those refunds.

Waiver of Liability

Responsibility / Liability

By my signature as set forth on the booking form I acknowledge and confirm the following

I waive any and all claims I may now and in the future have against, and release from all liability and agree not to sue House For Positive Change, and its officers, employees, guides, agents or representatives (collectively its staff) or the licensor for any personal injury, death, property damage, or loss sustained by me as a result of my participation in an adventure, tour, travel, outdoor adventure retreats trip with them, due to any cause whatsoever, including without any limitation, negligence on the part of House For Positive Change, its staff and licensor. I am aware that your retreat/trip, in addition to the usual dangers and risks inherent, has certain additional dangers and risks, some of which may include physical exertion for which I may not be prepared; weather extremes subject to sudden and unexpected change; remoteness from normal medical services; evacuation difficulties if I am disabled. I accept all the inherent risks of the proposed retreat/trip and the possibility of personal injury, death or property damage or loss resulting therefrom.

I acknowledge that the enjoyment and excitement of adventure travel is derived in part from the inherent risks incurred by travel and the activity beyond the accepted safety of life at home or work, and that these inherent risks contribute to such enjoyment and excitement, being a reason for my participation. I agree that if I suffer injury or illness House for Positive Change, can, at my cost, arrange medical treatment and emergency evacuation service, as they deem essential for my safety. In entering into this Agreement, I am not relying on any oral, written nor visual representations or statements by House for Positive Change or its staff or any other inducement or coercion to go on a trip, hence, only of my own free will. I confirm that I have read and understood the terms and conditions of the contract and this Agreement prior to signing it and agree that this Agreement will be binding upon my heirs, next of kin, executors, administrators and successors.
